How It Works

The Visa Bulletin published monthly by the State Department shows which priority dates are "current" (eligible to file or be approved). Each EB category and country advances at different rates. India EB-2/EB-3 has the most severe backlog, sometimes advancing only 2-3 months per year.

The Formula

Gap = Priority Date - Current Cut-Off Date
Estimated Wait = Gap (months) / Advance Rate (months per year)

Variables

  • Priority Date — The date your PERM/I-140 was filed
  • Cut-Off Date — Current date shown in the Visa Bulletin for your category/country
  • Advance Rate — Historical average months the cut-off moves forward per year

Example

An EB-2 India applicant with a June 2020 priority date: current cut-off is around mid-2013, gap is ~84 months, advance rate is ~3 months/year, so estimated wait is ~28 years.

Tips

  • The Visa Bulletin has two charts: Dates for Filing and Final Action. Check both.
  • Advancement rates can speed up or slow down based on demand and legislation.
  • EB-1 India has improved significantly in recent years.
  • Consider EB-1 downgrade or country of chargeability if eligible.
  • Some months the dates retrogress (move backwards). This is normal.
